Abstract:
The article presents the analysis of the constitutional basics of the judicial system in the Republic of Serbia. In accordance with Section I of the Serbian Constitution of 2006, the rule of law and the independence of the judiciary in the system of powers separation form the fundamental core of the constitutional order of the Republic of Serbia. These basic principles of the new Constitution of Serbia were developed in Chapter 7, «Courts». The provisions of Chapter 7 form the basis of the status of judges, procedure of organization and activities of the judiciary, administration of justice in the Republic of Serbia. Constitutional principles are applicable to all types of courts, that expresses the unity of the judicial system of the country. Analyzing the content of the constitutional basics of the judicial power in contemporary Serbia, the author comes up to the conclusion that on the one hand they keep the path of constitutional tradition of Serbia since the adoption of the first constitutional acts of an independent Serbia and the democratic Constitution of the Kingdom of Serbia 1903, and they are consistent with the international standards in the sphere of organization and administration of justice, on the other.
