Abstract:

The article is devoted to the determination of the content of the term "discretion" used in civil law and to domestic civil law. Studied the importance of the category of "discretion" in certain sectoral legal Sciences. It is concluded that in private law the discretion should be understood as the process of implementation of self-generated will of subject of civil law
