Abstract:
The Socialist Federal Republic of Yugoslavia after adopting the Constitution in 1963 became the first socialist state which implemented the European model of constitutional control in its constitutional system. As a result, the institute of the constitutional justice of Bosnia and Herzegovina is one of the oldest in the countries of Central and Eastern Europe. Nevertheless, it is very difficult to discover traces of succession in the current constitutional court of Bosnia and Herzegovina. One of the main reason of the lack of succession is the framework of circumstances and conditions in which the Constitution of Bosnia and Herzegovina of 1995 has been adopted. Those circumstances had direct influence on the system of state power and bodies. Since that time the Constitutional court of Bosnia and Herzegovina is playing fundamental role among these state bodies. Authors of the Constitution intended to empower the Court as the main element of the system of checks and balances in the state. The article suggests a legal analysis of the status of judges of the Bosnian constitutional court. Analyzing the requirements for the constitutional judges candidates, their rights and duties, their immunity and expiration of their powers, the author pointed out the advantages and disadvantages of the Bosnian legal regulation for the constitutional judges, and proposes models of its improvement.
