The article deals with the so called defence function of constitutional rights. The fundamental function of basic rights and freedoms boils down to preventing public authorities from interfering with personal sphere of life. The special attention is paid to differentiation between negative and positive rights. The latter do not exclude acts of public intervention into personal sphere of life. On the contrary, they even invite such intervention in some instances. The said differentiation is backed by the analysis of several cases tried before constitutional and statute courts of member states of Russia.
