Abstract:

The article considers the dynamics of ownership forms in the domestic law and the state. Showing the problem of determining the legal regime of different forms of ownership. The article presents the historical experience of legal regulation of forms of ownership, when in the Soviet period there was a differentiation of legal responsibility and, in particular, criminal responsibility for infringement of property of various forms. In this case, for theft of state and public property were set to the maximum heavy responsibility in contrast to the attacks on personal property of citizens. In modern Russia, any inequalities in the forms of ownership that are granted the same legal protection have been removed. It is noted that the existing differences in the legal regime of different forms of ownership are due to the specifics of transactions with state and municipal property, as well as property of citizens and legal entities.
