FALSIFIED MEDICINAL PRODUCT AS THE SUBJECT OF A CRIME UNDER ART.238.1 OF THE CRIMINAL CODE OF THE RUSSIAN FEDERATION

Relevance: the relevance of the topic proposed for the attention of the article is due to the need to improve the legislative formulations concerning the institution of criminal liability for the illegal circulation of medicines and medical products. Consideration of this issue predetermines the significance of the problem of the crime subject to article 288.1 of the Criminal Code of the Russian Federation. In this scientific article, we are making an attempt to critically comprehend the concept of «falsified medicinal product». Methodology of the study: the methodological basis of research unites the principles of dialectical cognition of reality; the basis of a systematic approach to the characterization of social, legal processes and phenomena, as well as private scientific methods of conducting research. Main results of the study: the following definition of a counterfeit medicinal product is proposed: a substance that is knowingly falsely given for a medicinal product. Scientific and practical significance: the scientific and practical significance of the results of the research is that it is expedient to use the conclusions formulated in it for: - further development of the foundations for studying the institution of criminal liability for the illegal circulation of medicines and medical products; - optimization of legislative and law enforcement activities in the field of implementation of the criminal law standards of the institution of criminal responsibility for the illegal circulation of medicines and medical products; - teaching the course of criminal law in higher and secondary educational institutions, as well as in the system of professional development. The article is intended for teachers, post-graduate students, undergraduates, law enforcement students and anyone who is interested in the problems of criminal liability for the illegal circulation of medicines and medical products.
