The article examines the changes of civil legislation regarding real estate mortgage agreement. The consequences of exclusion of state registration have been revealed; the subject of real estate has been established that is the property the pledgor will acquire in the future and the right that will arise in the future from the existing or future obligation. Special attention is devoted to mortgage due to the law about the right of claim on partnership agreement in the sphere of construction. The relations between the lender - pledgeholder and borrower - pledger have been subject to comparative analysis, the difference of mortgage agreement regarding the property the right to which will arise in the future, from the mortgage agreement regarding the right of claim on partnership agreement in construction have been revealed. The conclusion has been made that pledge of right of claim on partnership agreement is a more reliable means for the pledgeholder to secure performance of obligations under loan agreement.
