Abstract:

The purpose of writing the article was the results of a study of the problems of skill faced by law enforcers in the classification of torture the use of torture (paragraph «d» of part 2 of article 117 of the criminal code). The author of the work concludes that the legislative construction of a crime under paragraph «d» of part 2 of article 117 of the criminal code (torture committed with application of torture), is imperfect, and requires amendment of the criminal law in this part. The results of the study presented in the paper will be useful in the classification of crimes in this category.
