Abstract:
In this article the author discusses one of the issues of civil regulation concerning possession and its protection under the law of the Russian Federation and the Swiss Confederation. Theoretical and practical importance of this problem is related to the specific nature of the possession`s protection, its relevance in the Russian legal reality and to the coming reform in the field of property law in Russia. In the proposed work the author considers the peculiarities of the possession’s protection in modern Russia and over the long term of the civil reform in comparison with its regulation in the Swiss Confederation. The author focuses on the analysis and comparison of the sources of property law, types of possessory actions and grounds for filing ones; as well as application of other remedies in the selected states. Moreover, this article is an essential part of the author`s bachelor degree work. The results of this study are of interest for domestic and foreign lawyers and might contribute to legal improvement of the regulation of possession`s protection.
