LEGAL BASES OF CONSIDERATION OF FAS RUSSIA OF COMPLAINTS TO ACTIONS (INACTION) OF SUBJECTS OF PUBLIC PURCHASES

Problem of writing of this article - to investigate the mechanism of consideration of FAS Russia of complaints to actions (inaction) of subjects of public purchases. Model / methodology: when carrying out a research various methods of knowledge have been used: general scientific (dialectic, system, structurally functional) and private scientific (legallistic, analysis, synthesis). Application of the specified methods has given the chance to analyse the feeder and considerations of complaints to actions (inaction) of subjects of the legal relationship arising concerning implementation of purchases of goods, works, services for the state (municipal) needs, to reveal his features, to formulate the offers directed to improvement of institute of the appeal in the sphere of public purchases. Conclusions: the institute of the appeal includes the norms determining conditions and terms of the complaint, requirement to form and content of the address, power of FAS Russia as control body in the sphere of public purchases by consideration and decision-making on the arriving complaints. The institute of the appeal demands the further development, in particular, by expansion of the basis for submission of complaints. Framework research/a possibility of the subsequent use of results of scientific work: author's conclusions can be taken into account during further scientific research concerning the appeal of actions (inaction) of participants of purchasing activity. Practical value: author's conclusions can be used in law-making, law-enforcement and research activity. Originality/value: the scientific article will be interesting to subjects of purchasing activity, representatives of bodies of the public power, scientists, teachers, graduate students, students.
