Abstract:
Introduction: In the present article describes the concept of legal fact in terms of having different approaches to the definition of the legal nature of the legal facts. Objective: To identify the features of the legal facts in civil proceedings from the point of view of establishing the general and specific principles in the concept of legal facts. Model: During the writing of the article used the method of comparative law, the analysis and synthesis of historical reconstruction. Results: The author analyzed the existing different definitions of legal fact, its required elements. Conclusion: defining the specifics of the legal fact in civil proceedings should not be narrow legal fact only to the disposition of the legal norm. This hypothesis defines a specific legal fact, which will be the basis of origin, changes, termination of the legal relationship. At the same time, it defines the legal fact and behaviors inherent in the dispositions and as a consequence of the occurrence of certain legal consequences. The third element of a legal norm - the sanction is also associated with a legal fact, since the onset of the legal consequences outlined in the disposition rule of law is supposed to, but the actual pattern of behavior may deviate from the expected.
