Abstract:
The article is devoted to the problems of legal regulation of Biomedicine. Cell therapy in the future will be able to effectively deal with many dangerous diseases: cancer, Alzheimer's and Parkinson's diseases, multiple sclerosis, diabetes; the consequences of heart attacks; severe burns; bone defects, etc., so the legal regulation of these issues is especially important today. Methodology: using the methods of structural analysis and synthesis, comparative - legal, dialectic, formalno-logical and techno-legal the author has identified some shortcomings of the legislation on Biomedicine. The article reveals the basics of legal regulation of Biomedicine. The law of the Russian Federation from June 23, 2016 No. 180-FZ «On biomedical cell products», reglamentary turnover, as well as preclinical and clinical studies of the so-called biomedical cell products, by which is meant viable cells of the same type (cell line) derived from biological material, which together with auxiliary substances and medicinal products may be applicable in respect of a donor of biological material (autologous CDB), and in relation to other people (allogeneic BKP). First of all, we mean cellular vaccines and developments in regenerative engineering. Results: it is noted that the Law does not specify-who is responsible for the development and testing of methods for the use of CT, informing about the optimal dosage and order of use of cellular products for each specific disease, and in what time it should be executed; It is pointed out that it is necessary to elaborate and specify the feasibility of the allocation of an independent funding line for the SBS themselves by including them in the basic program of compulsory health insurance. Conclusions: in conclusion, it is proposed (taking into account international approaches to the regulation of cellular technologies) to continue working on schemes of various incentives: tax incentives, subsidy packages, grants, special conditions for access to infrastructure through PPP, concession agreements, etc.
