QUESTIONS OF DELIMITATION OF CIVIL-LAW RESPONSIBILITY IN CASE OF CRASH

The necessity of writing this article is conditioned by the needs of scientific understanding of the civil liability of the air carrier in the event of an air crash. The research is based on the use of methods of content analysis, statistical and comparative legal analysis. The theoretical basis of the study is the provisions and conclusions contained in the works of Russian and foreign scientists considering the responsibility of air carriers: Gushchin V.Z., Kamolov S.G., Kostennikov M.V., Makhiboroda M.N., Moshkovich M.A., Zavoykina N.P., Savenkova O.V. The article deals with the current state and the main problems of delineating civil liability of an air carrier in the event of an air crash. An analysis is given of existing mechanisms for compensating victims of air crashes, compensation for losses for the loss of baggage and cargo. The main expected consequence of the publication is the optimization of the basic approaches of the legislator to the practice of distinguishing civil liability of an air carrier. The article is addressed primarily to the legislator, law enforcers, researchers, teachers, graduate students and students of law schools.
