Abstract:
The Constitution of 1901 combined the liberal ideas of radicals and the conservative ideas of progressists. According to Article 1 of the Constitution, Serbia was a hereditary constitutional monarchy with the People's Representation. The Constitution of 1901, unlike the Constitution of 1888, did not even mention the principle of separation of powers. The king was a bearer of executive powers and possessed significant powers in the legislative sphere. The People's representation for the first time in Serbian history had a bicameral structure. Unlike the Constitution of 1888, the Constitution of 1901 provided a «non-parliamentary» composition of the Government. The ministers could be brought to criminal responsibility under the conditions stipulated by the Constitution of 1869. Only one article was devoted to the judiciary in the Constitution of 1901. Such an original system of public authorities corresponded to a peculiar catalog of constitutional rights, the analysis of which is presented in this article.
