Abstract:

The article deals with the problem of differentiation of criminal responsibility, which is impossible without detailed theoretical and legal bases of development, including juvenile crime, differing characteristics of the subject. It is stated the need for a new, comprehensive approach to the reform of criminal law, which would fully meet the requirements of individualization of responsibility of juveniles and strengthen the preventive part of the criminal sentence. In this regard, taking into account scientific developments and foreign experience of legal regulation of the variants of the categorization of offenses allowing to take into account personal characteristics of the juvenile offender.
