Abstract:
The article deals with the problem of the interaction of politics and law. The author focuses on the ideas of the famous German philosopher Carl Schmitt, who advanced to the twentieth century progressive views, pointing out that in modern society, the power should belong to the law, and not the state, political society that appears there, and when the state something it is not "handled", not ‘overcreated’ in law and in this case there are questions concerning the whole of society at the same time and requiring exclusive solutions. Attention is paid to the causes of the difficulties in dealing with relationship between politics and law for Soviet Russia and modern. Particular attention is paid to the analysis of the causes of the subordination of law and policy factors find their future intelligent interaction.
