Abstract:
Head of organization is a key employee of the company, which directly impacts on its production results. For that matter as one of the mechanisms of control over the head of organization activities, Russian legislation establishes the employer’s right to set forth additional grounds for termination of employment contract with the head of an organization. However, the legislator had not sufficiently regulated this legal ground for termination of employment relations. This article provides results of analysis of practical problems related to termination of employment relations with the head of organization and ways of their solutions. This article also provides comparative analysis of this legal ground for termination of employment relations in Russian Federation and certain foreign jurisdictions. The research is based on the analysis of Russian legislation and court practice, as well as the respective Russian theoretical researches. This article is intended for students, postgraduate students, practical lawyers, employers, HR specialists, heads of organizations and potential head of organizations.
