Abstract:
Carrying out inspections in relation to legal persons is regulated by the 294-FL, but its rules do not apply to the exercise of prosecutorial supervision and the Law on Prosecutor's office this issue is not regulated, which creates the appearance of problems of law enforcement or the legislative omission. On this basis, entrepreneurs are forced to get involved in the judicial appeal of actions and decisions of prosecutors. Analyzes the legal consequences of the Ruling of the constitutional Court of the Russian Federation dated 17.02.2015 no 2-N and the Order of the Prosecutor General of Russia from 28.05.2015 N 265 on the execution of this decree.
