Abstract:

The article deals with current issues pertinent to alternative (out-of-court) methods of settlement of disputes. The author dwells on the background of the issue, reviews the legal basis for organization and operation of non-governmental arbitration (alternative proceeding) in the Russian Federation, and analyzes fundamentals of the legal status of arbitration tribunals. Special attention is focused on a fairly new (for the Russian legal system) institute of the alternative procedure for settlement of disputes with participation of confidant (the mediation procedure). Whereas the author undertakes a research of the legal status of the mediator as neutral, independent person rendering assistance to the parties in settlement of a dispute; explores the problems in application of mediation under the given social and economic conditions; studies its main distinctive peculiarities.
