Abstract:
In article such legislatively fixed plunder signs as gratuitousness and illegality are analyzed. During work methods of materialistic dialectics, the analysis and synthesis, legallistic were used. Importance of a sign of gratuitousness of withdrawal of property at plunder for the characteristic of public danger of this act is emphasized, and also for a plunder otgranicheniye from adjacent corpus delicti. The content of various aspects of illegality of plunder reveals, the conclusion about possible withdrawal of this sign from legal definition of concept of plunder is drawn.
