Abstract:
As independent state bodies, constitutional courts protect the Constitution by resolving constitutional disputes. As a result, they are often called "Guardians of the Constitution." The main activity of the constitutional courts is the control of the constitutionality of laws and other legal acts. In constitutional theory, there are such forms as: preliminary and subsequent constitutional control, which have their advantages and disadvantages. At the present stage, the Constitutional Court of Serbia is authorized to exercise both preliminary and subsequent constitutional control. The constitutional legislation of Serbia, stipulated the procedure for exercising preliminary constitutional control, has a number of specific features, the analysis of which is presented in this article.
