Abstract:
Purpose: the urgency of the topic, the insufficient level of its scientific development, predetermined the research objectives, which consist in analyzing the status of the current legislation at the stage of preparing the case for trial, identifying the main problems, development tendencies and ways to improve modern norms of law. Methods: the methodological basis of scientific research is a general scientific method of cognition combined with certain private scientific methods: the method of using the laws of formal logic, the historical method, the method of comparative law, and also the systematic analysis of general theoretical works and works studied in this paper. Results: his article is devoted to the study of the preparation of the case for litigation from the point of view of achieving the tasks of optimizing civil proceedings. Author's proposals for improving the institute under consideration are presented. Practical significance / value: the main provisions and conclusions of the article can be used in scientific and pedagogical activity when considering questions about the optimization of civil proceedings.
