Abstract:
The article is aimed at clarifying the scientific understanding of the trends in the development of pre-revolutionary Russian justice of the early 20th century and its social foundation. On the basis of historical-materialist methodology the author substantiates the conclusion that a significant deviation of the Russian judicial system from the model laid down by the judicial reform of 1864, as well as its increased repressiveness eventually were caused by peripheral and dependent nature of Russian capitalism. This idea strengthens and concretizes the thesis that the pre-revolutionary Russian legal order developed in a direction contrary to the ideal of «the rule of law».
