Abstract:
This article analyzes the characteristics of the objective side of destruction or damage of forest and other vegetation. It was found that a socially dangerous act committed by him can be expressed in the form of action and inaction, that is represents the acts of human behavior, is the impact on the environment by failing fire safety measures when using a source of increased danger, arson, other generally dangerous method, or as a result of contamination or other adverse effects. Destruction or damage of forest and other vegetation is a consequence of the crime, not an act of action or inaction. It is proposed to make a further point to 24.1 Resolution of the Plenum of the Supreme Court of the Russian Federation dated October 18, 2012 № 21 "On the application of legislation on liability for violations in the field of environmental protection and natural resources" .
