Abstract:
The present article is dedicated to the examination of the matters of argument, concerning the issue of the agency agreement subject. The comparison of the commission contract’s, engagement agreement’s, agency agreement’s subject matters is provided. The notions of legal action, action of fact, deal are analyzed. The peculiarities of the agency agreement subject stipulated in Russian legislation and the Continent Europe states legislation using Germany and France are emphasized. On the basis of the study of the civil provisions, precedents and business documentation, the suggestions to improve the civil legislation in part of the agency agreement subject matter and the agent’s ability to provide the actions of fact exclusively are made.
