Abstract:
Grounds for disputes on competence between public authorities may be different, but their resolution should be assigned to a neutral arbitrator located outside the traditional system of separation of powers and capable of resolving a political dispute on the basis of specially established legal procedures. Such a body is undoubtedly the modern constitutional court. The Constitutional Court of Serbia is an autonomous and independent state body which protects constitutionality and legality, as well as human and minority rights and freedoms. It resolves disputes concerning competence between courts and other state bodies, between republic and provincial bodies or bodies of local self-government units, between provincial bodies and bodies of local self-government units, etc. Thus, the Constitutional Court of Serbia resolves both vertical and horizontal disputes on competence, protecting the principles of the rule of law, constitutionality and legality, separation of powers, as well as the right to regional autonomy and local self-government. An analysis of the competence of the Constitutional Court of Serbia to resolve disputes on competence is the subject of this article.
