Abstract:
Background. The article is devoted to legal regulation of labour relations complicated by a foreign element within the BRICS countries, is aimed at the identifying of the main problems faced by the countries with a legal system belonging to the different - civil law and common law - legal orders at the inclusion of the labor in the circulation of goods and services in the context of labour migration. Methods. This work is done with the use of the following scientific methods: systemic analysis and synthesis of normative acts and practical materials, formal and dialectical logic: analysis, synthesis, induction, deduction, hypothesis, analogy, and special methods of legal studies - comparative legal and historical-legal, systemic analysis and interpretation of legal norms. Discussion. In this article attention is paid to the legal regime of the main working conditions such as time of work and rest, wages, and the very concept of «individual employment contract», including its conclusion and termination within the BRICS countries belonging to the different - civil law and common law - legal orders. Results and their further practical use. The author offers a comparative legal study that opens opportunities to predict the direction in which relative legal regulations can be made in the future taking into account the urgent needs for the improvement of the existing Russian legislation.
