Abstract:
The study is written with the aim of developing a new concept of proof in the criminal process. For a successful socio-economic development, Russia needs to reform criminal justice. While the Russian criminal procedural law remained the semi-Soviet, semi-competitive, mixed. Especially archaic is the preliminary investigation and the underlying model of the formation of pre-trial evidence. It determines the accusatory court of justice, making it unable to provide the system combating the most dangerous forms of crime. Many of the countries that had the Soviet model of criminal procedure and law of evidence (Georgia, Moldova, Ukraine, etc.) in recent years has moved to an entirely new legal standards, the relevant fair trial. European standards of fair trial corresponds to the adversarial model of evidence. The author of the article as a theoretical and methodological framework used a "model of Doctrinal evidentiary law of the Russian Federation" developed by the Nizhny Novgorod school of processualists. He had as role models of the criminal procedure rules that exist in the developed European countries. As the underlying model was based on the model knowledge of subject evidence undertaken by the court in terms of the adversarial court procedure. In this approach, the pre-trial stage of the case is not the main preparation, albeit an indispensable means of knowing the truth. The author proceeded from the fact that the main subject of cognition is the court that assesses the facts according to their own conviction. The parties, including the prosecution, which identifies, investigates and uncovers a crime, preparing the actual material for the study in court. The article presents the author's view on how to change the formation of evidence during pre-trial proceedings in a criminal case. The task of the investigator as an agent of the indictment of the authorities is to receive and submit to the attorney such evidence on the basis of which the state Prosecutor can convince the court the presence of grounds for bringing to criminal liability of the person who really committed the crime. For the court this material is the main source of information on the subject of proof. It is important that the sides were equal in the formation of this material and study it. Forensic evidence can be formed only with the participation of the court or the investigative judge. Offers to enter into pretrial investigative judges, which could be the Deposit of evidence. The author's project of forming criminal procedure evidence contributes to the development of scientific discussion on a new the law of evidence and legal model of pre-trial proceedings. The author's conclusions about the regularities of formation of evidence during pre-trial proceedings in the court contribute to the formation of the controversial doctrine of the law of evidence. This is a necessary conceptual prerequisite for the creation of a new Russian criminal procedure law. In turn, this will be part of the modern criminal policy of countering the most dangerous threats to the security of the Russian Federation.
