On the Problem of the Correlation of the Categories of Freedom of Labor and Right to Labor in the Constitutional Doctrine and Decisions of the Russian Federation Constitutional Court

Task: The fundamental law of the state acts as the base of some explanation of legal categories, constructions. The inaccuracy in conveying the constitutional categories embodied in the constitutional norms generates either some misunderstanding or ambiguity of such understanding. An example of such an inaccuracy can be the provision of Article 37 of the RF Constitution on the rights and freedoms in labor sphere. To explain the sense of the appropriate constitutional provisions one should analyze the essence and contents of the categories of “freedom of labor” and “right to labor”. Nowadays the problem of understanding the given categories is interesting for legal community not only in Russia but abroad (V.V. Zhernakov, the Ukraine, K.K. Urzhinsky, Belorussia, etc.) Materials and methods: The research base of the work is compiled from scientific views of jurists, normative legal sources and materials of court practice analyzed through general and special methods of scientific cognition. Conclusions: In the article the author gives the over-all appreciation of the constitutional categories “freedom of labor” and “right to labor”, analyses their essence, determines the content of the given categories and reveals the peculiarities of the way of establishing the given provisions in the RF Constitution. Possibility of subsequent use of the results of the scientific work: The author made a special contribution to the research of the subject-matter by introducing a number of concrete proposals directed at removing some inaccuracies in the formulation of separate legal norms of the Russian legislation. Social consequences: The introduction of these changes allows the members of the society to understand their labor constitutional rights and freedoms more precise and it can be one of the conditions for defending them more effective. Originality and importance: The results of the given work can be useful for jurists I regulating the provisions on freedom of labor and right to labor in various spheres of man’ life, law scientists in research, law students to understand the essence of the constitutional provisions on freedom of labor and right to labor.
