Attorney-at-law’s duty to cognize criminal case

The implementation of the adversarial principle in criminal proceedings requires the active participation in it defense counsel, however, this activation of a lawyer during the preliminary investigation inevitably leads to issues including those relating to duty counsel to establish the circumstances of the criminal case and his responsibility for the improper performance of duties. Now these questions are not yet adequately addressed in the literature, although the development of the concept and model of a lawyer during the preliminary investigation makes it necessary to examine them. Finding answers to these questions is the aim of the present work. To achieve this, the author uses the method of logical analysis, the method of transition from general concepts to specific, formal-legal method. The question of the responsibilities of a lawyer to establish the circumstances of the criminal case, the author considers the aspect of criminal procedure the defense responsibility, disciplinary responsibility of a lawyer and civil liability to the principal. Studied the view of some researchers studied rules of law, legal ethics rules governing the participation of a lawyer in criminal proceedings .. The author concludes that there is no statutory obligation criminal procedure lawyer to establish the circumstances of the criminal case, said that the participation of a lawyer in the establishment the circumstances in criminal cases, its civil liability to the principal may be established in an agreement concluded between them, and disciplinary liability for the improper performance of their duties counsel may be applied to him by the authorized body of the regional bar association. Performance results of scientific research, no doubt, may be a reason to continue the scientific debate about the role of the lawyer in establishing the circumstances of the criminal case. The author's conclusions, he developed the position of attracting lawyers accountable for improper implementation of security features can be used to adjust the code of legal ethics, a model of action for the qualification commissions, crucial questions the status of a lawyer as well as used in the preparation of teaching materials for the training of legal personnel, choosing lawyer specialization.
