Abstract:
The article analyzes the characteristics of the judicial investigation by the appellate review of a criminal case. There are mentioned the exceptions from the principles of competition, equality of the parties, immediacy of the investigation of the case in the court of appeal. There аre specific manifestations of the activity of the presiding judge during the investigation.
