Abstract:

Purpose: One of the most intractable problems in the context of analysis of crimes against administration procedure is the correspondence between objects of crimes - official document and other types of documents. The article is devoted to the controversial issues related to the uncertainty on the comprehension of objects of crime provided by the third part of Article 325 and first part of Article 327 of the Russian Federation Criminal Code. Methodology: Criminal legal analysis of signs of the important personal document is carried out, and its correspondence with other objects of crimes trespassed on the established order of the use of documents is examined. The latest court practice on the given problem is investigated. Findings: Author concludes that important personal document has all of the signs of official document; as a result, uncertainty of law enforcement activity is prevailed. Possible ways of resolution of this problem connected with the necessity of the elaboration of new approaches of awareness of the concerned objects of crimes are proposed. Originality: In the article the most relevant gapes in the lawmaking of crimes, which objects are official document and important personal document, are mentioned.
