Abstract:
In this work, the author makes a criminal-legal analysis of criminal arbitrariness for solving problems associated with the application of this norm by relevant subjects of the criminal process. The work is based on an analysis of current legislation and judicial practice. The normative fixing of the limits of significant harm in the consideration of cases related to criminal arbitrariness was proposed. The article is intended for specialists in the field of criminal law disciplines: scientists and practitioners.
