CONSTITUTIONAL PRINCIPLES OF THE LEGAL STATUS OF PERSONALITY IN THE REPUBLIC OF SERBIA

The 2006 Constitution laid the substantive Foundation of the modern legal system of the Republic of Serbia. It regulates the most important aspects of the life of the Serbian state and society. The Constitution contains a separate, part Two," human and minority Rights and freedoms", consisting of 64 articles and forming the basis of the right status of the individual in Serbia. In addition to Part Two of the 2006 Constitution, individual and collective human and civil rights in the Republic of Serbia are regulated in other parts of the Constitution (for example, Part Three, "Economic system and public Finances" and Part Five, "Organization of Power"). Thus, more than a third of the constitutional text is devoted to the regulation and protection of human and minority rights and freedoms. According to the Venice Commission, the Constitution of Serbia "fully covers all areas of "standard" human rights. And their content meets European standards, and in some aspects even wider.“ The core of the constitutional regulation of individual's status in the Constitution of 2006 is the "Basic Principles", the analysis of which is presented in this article.
