Abstract:
Goal - a study of changes to the procedural principles of disciplinary proceedings in respect of attorneys, enabled by the adoption of amendments and additions to the Advocate’s Code of Professional Ethics at the VI All-Russian Congress of Advocates. Model - the goal was achieved by means of a comparative analysis of the current norms of the Advocate’s Code of Professional Ethics and the norms of the Advocate’s Code of Professional Ethics that were in effect prior to the adoption of amendments and additions to said act by the VI All-Russian Congress of Advocates. Conclusions - having done the study, the author concludes that a significant part of the amendments and additions to the Advocate’s Code of Professional Ethics are aimed at improving the attorney’s position as that of a party to a disciplinary proceedings, as well as at endowing the bodies of the chamber of advocates of the unit of the Russian Federation with new dispositive powers, which is consistent with the interests of impartiality and justice in the consideration of complaints and requests concerning the attorney. Practical meaning - due to the high frequency of practical application of the provisions of the Advocate’s Code of Professional Ethics, which regulate the basics of the disciplinary proceedings in respect of attorneys. Originality/value - the work is intended for the members of councils and qualification commissions of the chambers of advocates of the units of the Russian Federation, attorneys, law faculty students and all those, who are interested in the matters and advocacy and the Bar.
