Abstract:
The article presents the analysis of the post-reform procedure of nomination and termination of powers of a judge in the Republic of Serbia. Modern Serbia has a strong constitutional basis of the legal status of judges. However, some questions concerning the normative regulation of the process of election and termination of powers of a judge, cause fair criticism of Serbian and foreign experts. These include three-year probationary period for newly elected judge and the overly important role of the National Assembly in the process of election of judges and presidents of courts, as well as reporting of the High Judicial Council to the National Assembly and, finally, exception from the Constitution of grounds and conditions of judge's termination of powers. Analyzing the content of "features" of the Serbian legislation regulating the election and termination of powers of the serbian judge, the author comes to the conclusion that they are consistent with international standards in the field of administration of justice.
