Abstract:
The goal of article is to make a general description of theft in Russian and German criminal law, to find out legal character and features of this crime which enable to distinguish it from other property crimes. In Germany papers of such scholars as J. Wessels, T. Hillenkamp, T. Fischer concern this issue. The comparative method used in this article enables better understanding of Russian criminal law’s rules in the sphere of theft. Results of study. According to the opinion of the author of this article, the rules that protect property operate not as separate rules but as an integral system. Referring to German experience the author asserts that the theft must be regarded as a crime only against tangible property and not against property as whole any part of which can be an item of crime. In author’ judgment such approach enables the rules of theft effectively protect movable tangible property from the property crimes. The originality and practical value. This article can be of interest for students, PHD-students and everybody who is interested in German criminal law.
