Abstract:
Background: At the present stage of development of jurisprudence and constitutional practice problems influence the decisions of the Constitutional Court of the Russian Federation on the criminal procedure law are increasingly becoming the subject of intense scientific attention . They are viewed through the prism of the theory of sources of law, legal protection, legal policy, legal doctrine of pragmatism et al. In the works of Russian (K.B. Kalinowskiy, E.D. Hozhaeva) and foreign authors (J. Desautels-Stein). Materials and Methods: The empirical base of the study was the decision of the Constitutional Court of the Russian Federation (judgment , determination , including the positive content ) , studied the author's procedure will reveal nodes conflict aspects of legal regulation and the main reasons for their occurrence. Results: The factors that influence how the process of legal regulation, and the degree of satisfaction of public and private interests in the legal protection. Conclusions: The basic directions of improving the law-making and law enforcement, formed by the method of analysis of the Constitutional Court of the Russian Federation as an indicator of the system of legal regulation.
