CIVIL LEGAL FUNCTIONS UNITARY ENTERPRISES INTO PROPERTY TURNOVER

The purpose of this research is the exposure and analysis of civil legal functions of a unitary enterprise in a property turnover. The reason for writing this article was the approval of “The Conception of the civil legislation development of the Russian Federation” by the decision of the President Council of the Russian Federation on 7th October 2009, which outlined a tendency to reorganization of the principal mass of unitary enterprises as an unpromising organizational juridical form of a juridical entity. The methodological basis of the work was systemic and functional analysis, and also a comparative juridical method of the research, by means of which the clauses of the active legislation of the Russian Federation, in its turn regulating the sequence of creating and work of a unitary enterprise, had been analyzed as well as the ideas of scientists-civilians on the topic of expedience of a unitary enterprise in the sphere of the market economics. In the article the author substantiates the conception of necessity to keep a juridical entity of the organizational juridical form in a property turnover, as the basis for socially-oriented economics of a legal state. The findings and results formulated in the research can be used in lawmaking and also in preparation of educational and methodological manuals for higher and secondary schools. The value and originality of the article consist of the author’s elaboration of a classification of civil-legal functions of a unitary enterprise, which can be used by the bodies of state power and by the bodies of local self-government in decision-making about creating of unitary enterprises and the affirmation of their regulations.
