Evaluation of evidence to internal certainty in criminal proceedings of Russia

Objective: The question of evaluation of evidence in criminal procedure is one of the most important within the resolution of criminal case, therefore the study of this topic has not lost its relevance for many years. The author of the article closely examines the appearance of free evaluation of evidence to internal certainty in Russia for the possible application of the definite provisions of the Code of Criminal procedure 1864 to today's legislative activities. Model: The article analyzes the main evolutional stages of the institution of evidence to internal certainty evaluation in accordance with the Code of Criminal procedure 1864, the Code of criminal procedure of the Russian Soviet Federative Socialist Republic 1960 and the Code of the Russian Federation 2001. Conclusions: Conclusions: The author concludes that adoption of modern criminal procedure laws requires careful study and consideration of the historical legal experience of our country, including such monuments as the Code of Criminal procedure 1864, which laid the basis for action of a just, humane and fair Court. Originality: The author makes a detailed retrospective analysis of the evidence evaluation question, citing the eminent Russian lawyers who worked on the issue in different historical periods of our country - from the end of 19th century to the present days.
