Abstract:
The article is devoted to analysis of normative correctness and appropriateness of rules on exemption from criminal responsibility. In work done a few accents. Firstly, justified an ontological substance regulations for exemption from criminal responsibility. Secondly, drawing attention to the correctness of the selected language is undoubtedly important rules to facilitate the process of investigation. Thirdly, doubts the appropriateness of exemption from criminal liability, which overlap. The article describes the rules for exemption from criminal responsibility of the general part of the CRIMINAL CODE, in conjunction with the relevant regulatory requirements of the special part. The matching process requirements of General and special part of the CRIMINAL CODE of the RUSSIAN FEDERATION, devoted to the release of criminal responsibility, and recommendations about going to apply similar requirements.
