Abstract:
The reasons for writing: improvement of the self-regulatory system of economic management requires a comprehensive research of all its elements, one of which is the Central and one of the most significant, are members of self-regulating organizations. Efficiency of self-regulation is impossible without consistent and clear definitions of basic concepts in this sphere, as the definition of the participants in the self-regulatory organizations, the separation of their types and applications, bringing to the state of balance of rights, duties and responsibility of participants of the SRO. Model: during the research the analysis of the legislation on self-regulation, as well as the local regulations of individual self-regulatory organizations was made. The criteria of classification of the SRO participants’ types are found, the changes in the scope of their legal status were traced, the signs of participants of the self-regulatory organizations were highlighted and a definition of this notion was given. Conclusions: the peculiarities of the mutual influence of business entities on a self-regulating organization allow you to select the external (optional) and internal (management) legal status of participants of the SRO, divide them into types depending on changes in the volume of competence and degree of influence on the self-regulating organization and self-regulation system in General. Value: scientific complex research of the issues connected with participation in self-regulating organizations will help eliminate the existing imperfections in the legislation on self-regulation and to make the system of economic management based on the principles of self-regulation, existing, effective and responsive to the requirements of the modern legal regulation of entrepreneurial activity.
