Abstract:

Article is devoted to releasing from criminal liability on the cases of crimes in the sphere of economic activity. In particular, the analysis of the reasons of fixing this basis in the criminal legislation is carried out. Horeover, the problems connected with the application and further action in practice of releasing from criminal liability of the persons, committed crimes in the sphere of economic activity in the context of Art. 761 of the criminal code of the Russian Federation, and as a result are revealed, the measures promoting elimination of gaps of releasing from criminal liability on the cases of crimes in the sphere of economic activity are offered. The conditions of releasing from criminal liability on the cases of crimes in the sphere of economic activity combine signs of the penalty and property confiscation.
