REGULATION OF CRIMINAL LIABILITY FOR MAKING A KNOWINGLY UNJUST JUDGMENT UNDER THE LAWS OF NEIGHBORING COUNTRIES

Abstract:
The article deals with topical issues of regulation of criminal liability for making a knowingly unjust judgment under the laws of neighboring countries. The author comes to the conclusion that within the framework of the conducted research it seems expedient to consider separately the features of the criminal law regulation of the punishability of the knowingly unjust judicial decision in the legislation of the countries under consideration. In this connection, the author concludes that in most of the countries studied (nine of fourteen), as well as in Russia, sanctions in the relevant standards (the main part) the lower limit of the penalty of deprivation of liberty corresponds to the minimum size set for this kind of punishment in the General part of the criminal law ("liberal approach"). In other countries, the lower limit of deprivation of liberty is higher (in three countries two years, in one three) ("moderately repressive approach"). The highest lower limit of imprisonment is provided for in the Estonian PC and is five years ("repressive approach"). The purpose of the article: This work aims to study the norms of the legislation of the near abroad on responsibility for making obviously unjust court decision. The author aims to identify both General and fundamental differences in the regulation of criminal liability for making knowingly unjust court decision in the legislation of a number of neighboring countries. Methodology and methods: the article uses the comparative legal method of research, as well as the method of interpretation of legal norms, which allow to better understand the institutions of criminal law and to determine the main directions of their development. Conclusions: the study of the experience of foreign countries seems to us not only useful, but also relevant for the further improvement of the norms of the Russian criminal law on responsibility for making a knowingly unjust judgment. Scope of application of the results: this article may be of interest to students of higher educational institutions: bachelors, masters, graduate students studying this area of criminal law, as well as this material may be of interest to teachers of law schools, can be used as a guide for the preparation of practical and seminar classes.
