Abstract:
Tasks: To analyze the scientific approaches of the determination the term «deviant behavior»; to show the correlation of the terms «deviant behavior» and «deviant legally significant behaviour»; to determine the determination and the essence of the term «deviant legally significant behavior». Methodology. In this article the problem of deviant legally significant behavior have been studied on the foundation of the dialectical method. The laws of dialectics are in the basis of theoretical and legal characteristics of kinds of deviant legally significant behavior, essence and classification of their causes, and also elaboration of preventive and enforcement measures. Then system method has promoted researching this problem as an integral unity and cognizing of the extent and nature of the close interrelation of its structural elements (torts, offences, abuse of the right and others). Also such scientific methods as analysis, and synthesis, induction, deduction, abstraction, the nomination of hypotheses are used here. Сonclusions: Deviant legally significant behavior is determined by us as multidirectional kind of behaviour in its legal ramifications (negative, positive and neutral), inconsistent to norms of law. It can be negative, for example, it harms helth and damages the property. In such cases, the law provides for the application of enforcement measures. Opposite the incentive measure (state award, prize, premium, international reward and etc) are set for deviant legally significant behavior with positive content. In addition deviant legally significant behaviour can be neutral, but the state power and society neither condemned nor approve it because of the insufficiency of the consequences. The main reason for the negative deviant legally significant behavior is the contradiction between the requirements of the normative system of the society and the interests of its members. On the one hand, they arise from adverse, unstable social situation. On the other hand, they create conditions for a stable negative situation. Deviant legally significant behavior can be combined, but must not be equated with psychical diseases and pathological conditions, addiction, addictive behavior. As the most common anomalies, combined with deviant legally significant behavior, we can call psychopathy, alcoholism, neurotic disorders, residual effects of cranio-cerebral injury and organic brain disease, intellectual insufficiency. Scope of the research. The results of the research can serve to theoretical and methodological base for the subsequent more in-depth research of this difficult problem. Originality − We give the term and determination «deviant legally significant behavior» for the first time in science.
