Abstract:
This article is devoted to problems of collision-legal regulation of relations arising in the field of e-commerce. Relations arising in the field of cross-border e-commerce is inherently complicated by foreign element that, in turn, gives rise to the problem of choosing the applicable law under consideration. For the relations arising in the field of cross-border e-commerce is particularly important in view of the lack of clear unified both substantive and collision-legal norms, and also because of communication such relationships at the same time with the right number of states (domain communication, business (operational) communications, communication residence, etc.), understanding of the issue, with some law and order is the one most closely linked to the whole. The article based on the analysis of documents ICC, the EU legislation, the US and Russia, and also doctrinal approaches are investigated especially the choice of the applicable law, the establishment of the closest connection to the conflict based on the principles of lex electronica and lex venditoris.
