The creation of an illegal armed formation or participation in it: the scale of the phenomenon

Urgency of the problem and the purpose of the study. Illegal armed groups, being a kind of organized crime, carry increased social danger to society, as members of such groups are armed, well trained and always ready to use weapons. Despite the fact that this problem was reflected in the works, both domestic (see, for example: Uzdenov R.M. Preventive effect of general social impact on the origins of extremism // Business -in-law. 2009. № 3. P.93-95 ) and abroad (see, for example: Abduhamitov V.A. Criminal legal characteristic of the organization of an illegal armed formation // Bulletin of the Kyrgyz-Russian Slavic University. 2007. № 10. P.116 -121) scientists, its solution requires further scientific understanding because of the high degree of Discussion of the proposed measures to counter this phenomenon. The article attempts to assess the actual condition and prospects of the dynamics of crime associated with the organization of illegal armed formations and participation in them. Methodological basis of research. In the study of criminological significant indicators crimes under Art. 208 of the Criminal Code, in addition to the official statistical data reporting (statistical method), we used the results of our survey of investigators of the Investigative Committee of the Russian Federation (the method of questioning and interviewing). All were interviewed 107 people. Key findings include: 1. Currently, the vast majority of the territory of the Russian facts organizing illegal armed formations and participation in them remain latent, as the number of perpetrators of these crimes. The real state of the corresponding figures in the tens and even hundreds of times higher than the official statistics. Number of crimes under Article 208 of the Criminal Code, which is comparable with the number of participants in the above-mentioned organizations, the tens of thousands. 2. Number of cases of organizing illegal armed groups and right-wing radical participation, taking place in Russia's largest metropolitan areas comparable to the number of cases the organization of illegal armed formations Wahhabi and participation in the North Caucasus. 3. Sharp ups and downs in the dynamics of the number of registered crimes of this species in the last fifteen years, not due to their real growth or decline, and socio-political factors-the most notable, tragic events, usually committing terrorist acts. 4. In general, the dynamics of the type of crime will keep the upward trend in long-term (5-10 years) and dalnesrochnoy (10-15 years) term, variable alternating peaks and troughs corresponding chart under short (next year) and medium-term (1-5 years) forecasts. Scientific and practical significance of the study. Scientific and practical significance of the work lies in the fact that its conclusions could be used for: - Improvement of law enforcement action to address problematic situations that arise during qualifications acts organizer or participant in an illegal armed group; - Improving complex Criminal measures aimed at preventing the functioning of illegal armed formations; - Teaching the criminal law in law and higher secondary schools, as well as in the training; - In research work in the further development of criminological problems of combating illegal armed groups. This article is intended for students, teachers and law faculties of law, law enforcement officials, legal practitioners, as well as for anyone interested in issues relevant topics.
