Annotation:
The author analyzes in the article of an offense under Article 144 of the Criminal Code (Obstruction of the lawful professional activities of journalists) pays special attention to the concept of a victim of crime, punishment of an offense and offers recommendations for improving the editorial called the criminal law. The purpose of this writing - show problems with law enforcement officials in the application of Article 144 of the Criminal Code, and their solutions. Foreign experts involved in research of these scientific issues: Adorno T., Johnson D., Carpenter E., Horkheimer M. Methodology - When writing this article, the following methods of scientific research: statistical, content analysis, a method of peer review. Conclusions: Revision of the objective side a crime under Article 144 of the Criminal Code needs to be improved. Legislator is advisable to define more clearly the range of persons covered by the notion of victim of crime. Proposed to introduce tougher penalties for that act. Scope of the study: The main focus in this article is devoted to the study of an offense under Article 144 of the Criminal Code, and the practical application of the criminal law. Practical value - This work contributes to the theory and practice of application of Article 144 of the Criminal Code. Provisions set forth in article useful for law enforcement officers, judges, and journalists. Social consequences - worded provisions in this paper can be used in legislative activities aimed at improving edition of Article 144 of the Criminal Code. Original publication - is the new recommendations on qualification crime under Article 144 of the Criminal Code.
