THE MECHANISM OF NON-TARIFF REGULATION AND EXPORT CONTROL IN THE RUSSIAN FEDERATION AND THE UNITED STATES LEGISLATION

Today politic largely affects the global economy, and governments are using different forms and methods of trade restrictions, the global situation is destabilized by the new armed conflicts. Considering these facts, the following issues become actual: the nature of non-tariff regulation, the legal mechanism for its implementation and the export control role as a non-tariff measure that ensure national security. The problem of non-tariff regulation of the foreign economic activity and the export control received considerable attention in the foreign (R. Vernon, D. Spar, R. Baldwin etc) and Russian (Dumoulen I.I., Troshkina T.N., Sagura N.Yu., etc) jurisprudence. Using the analysis and comparative legal methods, the author reveals the questions of the "non-tariff regulation" term, non-tariff measures classifications, and identifies the essential features of the non-tariff regulation. The comparative legal method was used for determination of export control; some defects of the formulation of the concept of export control were identified in the current legislation. It is concluded that under current circumstances the state economy regulation is also needed along with the market economy mechanism. The purpose of the export control, as one of the non-tariff measure is not only to regulate military products export, but also to protect national interests of the state. In this connection, improvement of the export control legislation is needed. The results of the analysis may be interesting for scientists, and may be useful for Russian and international companies that export their products and that use U.S. technology or the products of US origin in their work.
