Abstract:
The article examines violence as a sign of mass unrest. This kind of crime is a real threat to national security and public safety, in addition, in some countries such as the Republic of Kazakhstan and the Russian Federation in the moment it has a strong tendency to further growth, that's why defining the essential element of offence such as violence is vital. The author explores criminal concept for violence using systematic and structural analysis methods, analogy, abstract and comparative legal studies, refers to legal theory provisions, current criminal laws of Russia and Republic of Kazakhstan and regulatory enforcement. The author substracts two kinds of violence - physical and mental, both are used during mass unrest. Debating points arising when defining the mass unrest violence have been investigated. The author emphasizes unavoidable physical coercion on people in this situations. Simple and intelligible methods have been used in the article. Legal provisions he used undoubtedly deserve further scientific analysis and investigation as well as being tested as a future changes in criminal law for Republic of Kazakhstan and Russia. This provisions are pretty intelligible that's why they can be considered expedient in law textbooks and study guides, practical commentary to Criminal Code of the Russian Federation and The Republic of Kazakhstan
